122 Mr. Boylan asked the Minister for Agriculture and Food the reason a person (details supplied) has been refused area aid payment for 1995; and if he will make arrangements for payment to be made forthwith. [2510/98]

The person named submitted a 1995 area aid application on 19 May 1995 after the closing date of 28 April 1995. Consequently the application attracted a 100 per cent late application penalty.

An EU concession was obtained in respect of 1995 forage only area aid applications which had not a change of area between 1994 and 1995. As the person named declared 13.4 hectares as against only 8.28 hectares in 1994, however, that concession could not be applied in his case.

Unfortuantely, that the additional land he declared in 1995 came from his mother does not allow application of the EU concession, as a similar case of inter-family transfer of land referred to the EU Commission proved to be unacceptable.
