Question:

236 Mr. Ring asked the Minister for Social, Community and Family Affairs when an appeal will be heard in relation to a social welfare claim for a person (details supplied) in County Mayo. [4007/98]

This case has been the subject of a previous parliamentary question from the Deputy which was answered on 28 January 1998.

The file in the case has been considered by an appeals officer who is of the opinion that further clarification of certain matters is necessary. The matter has been referred to an investigating officer and the case will be considered further by the appeals officer on receipt of the investigating officer's report.

238 Mr. Ring asked the Minister for Social, Community and Family Affairs when an appeal for persons (details supplied) in County Mayo will be finalised. [4123/98]

In this case the persons concerned are husband and wife. The husband was in receipt of unemployment assistance at the weekly rate of £51.10 based on a means assessment of £96 per week, derived from income from farming. His payment included allowances in respect of his wife and three children. This assessment was carried out in 1993.

Following an investigation of the case, means from the holding were re-assessed at £170 per week, subsequently reduced to £152 per week. Based on this there is no entitlement to unemployment assistance.

The persons concerned have appealed the decisions in their case and the appeals officer is of the opinion that an oral hearing is necessary. This will be arranged as soon as possible.
