Question:

120 Mr. G. Mitchell asked the Minister for Justice, Equality and Law Reform if he will examine the case of a person (details supplied) in Dublin 9 whose estranged husband was charged with common assault with the charges being subsequently struck out even though the accused had pleaded guilty, as the garda concerned with the case was unable to be present for the sentencing though he was present for the hearing; and if he will make a statement on the matter. I am informed by the Garda authorities that the case referred to by the Deputy is listed for hearing at the Dublin District Court on 8 June 1998. In the circumstances, the Deputy will appreciate that it is not appropriate for me therefore to make any further comment in this matter.
