Mitchell asked the Minister for Justice, Equality and Law Reform if he will examine the case of a person (details supplied) in Dublin 9 whose estranged husband was charged with common assault with the charges being subsequently struck out even though the accused had pleaded guilty, as the garda concerned with the case was unable to be present for the sentencing though he was present for the hearing; and if he will make a statement on the matter.
