338 Mr. Neville asked the Minister for Agriculture and Food the reason a refund of super-levy for a 1996 and 1997 milk quota for a person (details supplied) in County Limerick has not yet been made despite firm guarantees given by the Department on 8 January 1998 that this refund would be made by 8 February 1998. [9369/98]

Super-levy is payable in a milk quota year if milk deliveries exceed the national quota. The super-levy liability is established at the level of the milk purchaser in accordance with the provisions of EU Regulations.

In this situation, any change in the levy liability of an individual producer requires a recalculation of the levy liability not only of that producer's milk purchaser but also of other purchasers as well. It is necessary therefore, to finalise all of the amendments before revising the levy liability for a super-levy year. The revision of the levy liability in respect of the 1995-96 milk quota year is now complete and it is expected that all of the necessary amendments will be processed within the next few weeks. The appropriate refund will be paid to the named person's milk purchaser at that stage.
The person named is not entitled to a refund of super-levy for the 1996-97 milk quota year.
