Question:

169 Mr. Ring asked the Tánaiste and Minister for Enterprise, Trade and Employment the advice available to persons who have paid an individual for a job but the work was never done; the powers, if any, she has to prevent this individual from continuing in business; and the action, if any, these persons can take to recover their money. [9196/98]

Neither I nor the Director of Consumer Affairs has any function in the specific matter. The consumer involved may need to take legal advice. If a consumer pays for a job and that job is not done then it is a matter of contract between the two parties. The consumer can pursue the matter through the small claims procedure in his/her local District Court if the amount claimed is less than £600. Advice on this process is available from the Small Claims Registrar in the local District Court. The Office of the Director of Consumer Affairs or the local citizens information centre also have information on the process.
