52 Mr. Browne (Wexford) asked the Minister for Finance the reason a person (details supplied) in County Wexford was charged stamp duty at the rate of 3 per cent for farm acquisition in view of the fact that the correct rate is 1 per cent if under 35 years of age. [10858/98]

I am informed by the Revenue Commissioners that relief from stamp duty on the transfer of land to a young trained farmer is dependent on a number of conditions being satisfied, one of which is that the transferee be under 35 years on the date of the transfer. The deed transferring the farm in this particular case was presented to Revenue in August 1997. The young trained farmer relief was not sought by the transferee at that time. If the transferee satisfies the relevant conditions then on application to Revenue any stamp duty overpaid will be refunded.
