The State carries its own insurance and the following is the position in regard to personal injuries sustained by gardaí driving official cars or motorcycles.
If a personal injury occurs and the State is liable because of fault or negligence then a claim can be made against the State.
If it is shown that another party is liable, for example, a traffic accident involving another vehicle, then a claim can be made by the injured person against that party.
In situations where personal injuries are maliciously inflicted on a garda, for instance, if a missile is thrown at or through the windscreen of an official vehicle and a Garda driver sustains injuries as a result, a claim for compensation can be made under the Garda Síochána Compensation Acts.
