215 Mr. Ring asked the Minister for Justice, Equality and Law Reform when a dealing in the Land Registry will be completed for a person (details supplied) in County Mayo in view of the fact the delay is causing financial hardship. [13609/98]
I am informed by the Registrar of Titles that this dealing refers to an application under section 49, i.e. acquisition of title by virtue of long possession, of the Registration of Title Act, 1964, which was lodged on 10 November 1997. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, take some time to process.
I am further informed that notice has been served on 5 June 1998 on all parties whose interests may be affected by the application in so far as such parties can be identified. If no objections are received within one month the case will proceed towards registration.
216 Mr. Penrose asked the Minister for Justice, Equality and Law Reform the steps, if any, he will take to request the Land Registry to expedite a dealing for a person (details supplied) in County Westmeath in view of the problems this delay is causing; and if he will make a statement on the matter. I am informed by the Registrar of Titles that the dealings referred to by the Deputy consist of two applications under section 49, i.e. acquisition of title by virtue of long possession, of the Registration of Title Act, 1964, which was lodged on 6 May 1997. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, take some time to process. Accordingly, it is not possible to estimate a completion date for the applications concerned at this stage.
I am further informed by the Registrar of Titles that another dealing lodged on behalf of the applicant, relating to a subdivision, is proceeding to registration and is expected to be completed in the next month.
