108 Mr. G. Reynolds asked the Minister for the Marine and Natural Resources if his Department ensures that the companies receiving funding comply with the Companies Act, 1963 by making annual returns. [14435/98]

I propose to take Questions Nos. 107 and 108 together.

Prior to payment of grant aid, all approved projects are required to comply with the tax clearance procedures laid down by the Department of Finance for payment by Government Department's and public bodies.
With regard to the Companies Act, 1963, there is no obligation on my Department to ensure that companies being awarded grant aid comply with the Act. However, in accessing any aid applications copies of up to date audited accounts are sought.
