298 Mr. Rabbitte asked the Minister for Justice, Equality and Law Reform if he will confirm that a defence has been filed to the court action taken by a person (details supplied) in relation to the position of refugee commissioner; the reason for the delay in filing the defence; and if he will make a statement on the matter. As I stated in my reply to Questions Nos. 636 of 21 April 1998 and 160 of 14 May 1998, the State's defence in this matter was lodged on 2 April 1998. There was no delay in filing the defence, which was lodged by the Chief State Solicitor following consultations with the relevant Departments.
