108 Mr. Broughan asked the Tánaiste and Minister for Enterprise, Trade and Employment the plans, if any, she has to provide protection to temporary employees of job agencies who fail to pay bank holiday entitlements. [16045/98]

The Organisation of Working Time Act, 1997, which implemented Council Directive 93/104/EC concerning certain aspects of the organisation of working time, sets out statutory rights for employees in respect of rest, maximum working time and holidays, including public holidays.

Employees of job agencies which fail to grant public holiday entitlements, including temporary employees who fulfil the eligibility criteria, may seek redress through the Rights Commissioner Service with an appeal to the Labour Court or the Employment Appeals Tribunal, as appropriate.
