Question:

369 Mr. Penrose asked the Minister for Justice, Equality and Law Reform the remedy or recourse, if any, available to complainants who feel aggrieved by the decision of the Director of Public Prosecutions not to prosecute in a particular case having due regard to the independence of the director; and if he will make a statement on the matter. [19562/98]

As the Deputy will be aware, my Department is not responsible for the Office of the Director of Public Prosecutions and the director is, by law, independent in the performance of his functions. However, I understand that it is always open to a complainant to write to the director asking him to review his decision and stating reasons, if not already disclosed, why he should change a decision.
