Vol. 496 No. 3

Written Answers. - Registration of Title.

Willie Penrose

Question:

384 Mr. Penrose asked the Minister for Justice, Equality and Law Reform if an application for registration by a person (details supplied) in County Westmeath will be expedited; and if he will make a statement on the matter. [22816/98]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49 — namely, acquisition of title by virtue of long possession — of the Registration of Title Act, 1964, which was lodged on 11 December 1996. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, take some time to process. I am further informed that the Land Registry issued queries on this dealing to the applicant's solicitor on 29 October 1998 and replies are awaited. The queries raised must be satisfactorily discharged before the matter can proceed. Accordingly, it is not possible to estimate a completion date for the application concerned at this stage. However, I can assure the Deputy that the Land Registry will do everything possible to expedite the resolution of this application.
