386 Mr. Gilmore asked the Minister for Justice, Equality and Law Reform the steps, if any, the Garda take to enforce section 13 (10) of the Roads Act, 1993, in regard to material deposited on roads, for example adjacent to building sites, particularly in view of the dangers that these materials can cause to motor cyclists. [22833/98]

I understand that local authorities have the primary role in enforcing the provisions of the Roads Act, 1993. However, I am informed by the Garda authorities that where offences under section 13 (10) of the Roads Act, 1993, are brought to the attention of the Garda authorities by the relevant local authority, and if sufficient evidence is available, offenders are prosecuted by the Garda.
