104 Mr. Creed asked the Minister for Agriculture and Food if a herd (details supplied) in County Cork has been deemed restricted in view of the fact that the herd owner claims that the herd is not contagious to any restrictive herd and therefore is not obliged to comply with regulations governing contagious herds to a disease outbreak. The herd of the person referred to was included in the brucellosis contiguous programme and scheduled for test on 12 September 1998 to be completed before 12 October 1998. As this test was not completed, the herd was restricted and a 14 day notice was served on the herdowner on 16 November 1998. However, it subsequently transpired that the contiguous land in question belonged to the son of the person referred to, who has the same name, and the herd was accordingly derestricted for brucellosis on 18 November 1998 and removed from the contiguous programme.

An annual TB and brucellosis round test was due to have been carried out on this herd by 25 October last but this has not been done. Effectively, therefore, the herd is again restricted due to the animal identity cards being out of date.
