Question:

81 Mr. Dukes asked the Minister for Education and Science if he has put in place the appeal mechanism envisaged in the Education Act, 1998. [3628/99]

The Education Act was signed into law on the 23 December 1998. Under section 1 of the Act, the various provisions of the legislation will be brought into effect by ministerial order. All sections of the Act must be commenced within two years from the passing of the Act. I assure the Deputy that it is my intention to implement all the provisions of the Act as soon as possible. I am currently considering, with my officials, how this might best be done.

Thus, although section 28, which deals with grievance procedures in the school, and section 29, which provides for appeals, in certain circumstances, to the Secretary General of the Department of Education and Science, have not yet been commenced, it is my intention to implement these, along with all the other provisions of the Act, as quickly as possible.
