Question:

285 Mr. Kenny asked the Minister for the Environment and Local Government the number and location of each truck weighbridge; the criteria that apply before charges of overloading can be brought against hauliers; the weights that are legal; the axle requirements that apply; and if he will make a statement on the matter. I refer to the reply to Question No. 272 of 24 November 1998. Details of the location of weighbridges are being forwarded to the Deputy.

The criteria which apply in relation to possible offences in this matter are specified in sections 12, 15 and 16 of the Road Traffic Act, 1961, as amended by the Road Traffic Act, 1968 and the Road Traffic (Amendment) Act, 1984. These relate to the specification of maximum weights, the definition of declared weighbridges and the requirements with respect to weighing.

The maximum permitted weights and axle requirements for vehicles in national traffic are specified in the Road Traffic (Construction, Equipment and Use of Vehicles) (Amendment) (No. 4) Regulations, 1996 and in the case of vehicles in international traffic in the Road Traffic (Construction, Equipment and Use of Vehicles) (Amendment) Regulations, 1992. Explanatory guidelines on the above have been drawn up by my Department and will be sent to the Deputy.
