Question:

72 Mr. McDowell asked the Tánaiste and Minister for Enterprise, Trade and Employment if she has received the report of the group headed by Mr. M. McDowell SC regarding company law; the main recommendations made; when the report will be published; the action, if any, she proposes to take on foot of the report; and if she will make a statement on the matter. I have for some time been very concerned at the clear indications that there is widespread abuse of, and failure to comply with, the requirements of our company law. For this reason I arranged for the establishment of a working group to advise on how best to address the situation.

I have received the report of the Working Group on Company Law Compliance and Enforcement, chaired by Mr. Michael McDowell, SC. The report makes a number of substantive and detailed recommendations. I am currently considering the report's conclusions and recommendations with a view to making proposals to Government in the very near future for appropriate action.

I intend to publish the report once it has been seen by Government.
