Question:99 Mr. Sheehan asked the Minister for Agriculture and Food the reason a person (details supplied) in County Cork did not receive a fodder grant. [4707/99]

In order to qualify under the 1998 winter fodder scheme a producer had to have mountain grazing and have an application submitted under the 1998 sheep headage scheme, or a herd number in one of the designated DEDs and have lodged an application under the 1998 suckler cow premium scheme and hold a suckler cow quota, or have a permanent milk quota of 35,000 gallons or less on 1 April 1998 and be active in milk production in the 1998-99 season.
The person named has a herd number in a designated DED, but did not lodge an application under the 1998 suckler cow premium or sheep headage schemes and was not an active milk supplier in the 1998-99 season. He did not therefore qualify for aid under the 1998 winter fodder package.

Question:100 Mr. Finucane asked the Minister for Agriculture and Food when payment of a beef premium will be paid to a person (details supplied) in County Limerick in view of the fact he has clarified that the plot referred to in his area aid is no longer rented by him; and if he will make a statement on the matter. The area aid application for the person concerned has been processed. However, the applicant claimed a parcel of land to which he has indicated that he is not entitled. Under the regulations governing area aid a penalty must be imposed as a result of this over-declaration. As the over-declaration is greater than 20 per cent of the land claimed the penalty imposed is that no area-linked grants are payable.
