Question:

326 Mrs. Owen asked the Minister for Justice, Equality and Law Reform the outcome of the investigation regarding wills of persons (details supplied) in County Down in response to representations made on behalf of a person (details supplied); and if he will make a statement on the matter. [6019/99]

I am informed by the Garda authorities that on 1 June 1984, a complaint was made by the person to whom the question refers concerning the alleged forgery of a legal mortgage on the family home. I understand from the Garda authorities that it was not possible to prove that a criminal offence had taken place at that stage due to the passage of time and the fact that persons necessary and essential to prove any alleged criminality were deceased.

I am further informed that the complainant also raised matters in relation to the estate of her father which were not matters for a Garda investigation. The Garda authorities are satisfied that the complainant was informed at the time that a criminal investigation was not warranted. I understand that the complainant subsequently corresponded with the Garda Fraud Squad on several occasions, but that no new facts that would alter the original assessment were brought to the attention of the Garda.
