Paul McGrath

Question:

243 Mr. McGrath asked the Minister for Justice, Equality and Law Reform the details of the re-entry to prison in March 1999 of a person (details supplied) who was released from prison resulting from a Circuit Court hearing on 12 November 1998; if there is a procedure for voluntary entry or re-entry to prison; and if he will make a statement on the matter. [10904/99]

I propose to take Questions Nos. 242 and 243 together.

A person remanded or sentenced by the courts is committed to prison on foot of a committal warrant-order issued by the courts. The prison authorities have to be satisfied that the person presented for imprisonment is the same as the person named on the warrant.

In the case of the person referred to by the Deputy, the person in question was received and held in Mountjoy Prison on 25 March 1999 on foot of a High Court order dated the same date and on foot of the warrant and orders cited therein.
