Question:

57 Mr. Durkan asked the Minister for Finance if a refund of income tax paid is due to a person (details supplied) in County Kildare; and if he will make a statement on the matter. [12525/99]

I am informed by the Revenue Commissioners that a revised certificate of tax-free allowances for the current tax year, 1999-2000, was sent to the taxpayer on 16 April 1999. This certificate increased the taxpayers tax-free allowances in respect of mortgage interest relief on the basis of the latest estimate, as provided by the taxpayer, of the amount of mortgage interest he is likely to pay in 1999-2000. Any refund of tax arising from the issue of the revised certificate of tax-free allowances will be made by the taxpayer's employer.

The inspector of taxes has requested the taxpayer to complete a return of income for the 1998-99 tax year and to return it, together with his and his wife's P60s, to the inspector. When these are received, the inspector will review the taxpayer's income tax liability for the 1998-99 tax year and make any refund that may be due.

58 Mr. Durkan asked the Minister for Finance when a P45 will issue to a person (details supplied) in County Kildare; and if he will make a statement on the matter. [12526/99]

I am informed by the Revenue Commissioners that, according to the information available to the inspector of taxes, the taxpayer's former employer issued a P45 in respect of the taxpayer on 11 March 1999. Part 1 was sent to the inspector and Parts 2, 3 and 4 to the taxpayer.

The inspector has no record of having received an application for a refund of income tax from the taxpayer since he ceased employment. The inspector has written to the taxpayer requesting information to enable the inspector to determine whether a refund of income tax is due.
