Question:

224 Mr. Spring asked the Minister for Justice, Equality and Law Reform if he will review his decision to refuse a naturalisation application to a person (details supplied) in view of the fact that the decision would appear to have been based on incorrect information regarding the applicant's place of residence. [19315/99]

The Irish nationality and citizenship legislation provides that the granting of a certificate of naturalisation is at my absolute discretion. The legislation also provides that an applicant must comply with certain conditions. These include that an applicant has five years residence in the State, is of good character and has an intention to continue to reside in the State following naturalisation.

I considered the application from the person referred to by the Deputy on the basis of the legislative provisions and the information contained on the applicant's departmental files. If the Deputy is in possession of information which he believes is at variance with the information which was available to me, I would ask him to write to me with further details. I will then give the case further consideration and advise both the Deputy and the applicant of the outcome.
