Question:

310 Proinsias De Rossa asked the Minister for Justice, Equality and Law Reform if his decision to deport a person (details supplied) will be re-considered; if all appeals by this person have been exhausted; when he envisages that he will have to leave; and if he will make a statement on the matter. [19871/99]

It has been established in accordance with Article 5(2) of the Dublin Convention that Italy is the responsible State for examining the application for refugee status from the person referred to by the Deputy. Italy has agreed to accept responsibility for the examination of the application. This decision has been upheld by the Dublin convention appeals officer.

Accordingly, I will shortly determine whether to make a deportation order to give effect to this decision. In deciding whether to make a deportation order, the Minister is required to have regard to a range of factors, as set out in section 3(6) of the Immigration Act, 1999. In the event that a deportation order is made, the person in question will be directed to present himself to a specified person at a given place, date and time for the purpose of his deportation from the State.
