Question:

363 Mr. Aylward asked the Minister for Justice, Equality and Law Reform if an application will be expedited for registration of a dwelling (details supplied) in County Kilkenny where the deeds were unable to be traced and the person is anxious to have the matter finalised as it is ongoing for the past number of years. [27008/99]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49 – i.e. acquisition of title by virtue of long possession – of the Registration of Title Act, I964, which was lodged on 25 Nov ember 1997. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims of registration as owners, can take some time to process.

I am further informed that the Land Registry issued their most recent query on this dealing to the applicant's solicitor on 10 December 1999 and a reply is awaited. The query raised must be satisfactorily discharged before the matter can proceed. I can assure the Deputy that on receipt of the required response from the solicitors the Land Registry will do everything possible to expedite the resolution of this application.
