Question:

546 Mrs. B. Moynihan-Cronin asked the Minister for the Environment and Local Government the local authorities, if any, which have taken legal proceedings against landlords who have not complied with Housing (Registration of Rented Houses) Regulations, 1996; the outcome of these cases; and if he will make a statement on the matter. [1671/00]

Information on local authorities who have initiated legal proceedings against landlords who have not registered their dwellings under the Housing (Registration of Rented Houses) Regulations, 1996, is published in my Department's annual housing statistics bulletins, copies of which are available in the Oireachtas Library.

Arising from legal action taken against a number of landlords by Ennis Urban District Council for non-compliance with the regulations, section 34 of the Housing (Miscellaneous Provisions) Act, 1992, was amended by section 33 of the Traveller Accommodation Act, 1998, to provide, in effect, that penalties for non-registration applied equally where a dwelling had previously been registered but the registration was not renewed as to a failure to register in the first instance. My Department is considering what further measures are required on foot of this legal action.

My Department has no information on the outcome of any of the other legal actions taken against landlords for non-compliance with the regulations.
