Question:

279 Mr. Penrose asked the Minister for Justice, Equality and Law Reform if he will expedite a section 49 application by a person (details supplied) in County Westmeath; and if he will make a statement on the matter. [2284/00]

I am informed by the Registrar of Titles that these dealings refer to an application for first registration and an application under section 49, acquisition of title by virtue of long possession, of the Registration of Title Act, 1964, which were lodged on 26 July 1999.

The Land Registry has been in ongoing correspondence with the lodging solicitor concerning these dealings and a letter containing final Land Registry requirements was sent to the lodging solicitor on 28 January 2000. I am further informed that notice has been served on 28 January 2000 by the Land Registry on all parties whose interests may be affected by the application in so far as such parties can be identified.

I understand that due to their complicated nature, first registration applications and applications under section 49, which require detailed examination of claims for registration as owners, can take some time to process. Accordingly, it is not possible to estimate a completion date for the applications concerned at this stage. However, I can assure the Deputy that the Land Registry will do everything possible to expedite the resolution of these applications.
