Question:

93 Mr. M. Higgins asked the Minister for Arts, Heritage, Gaeltacht and the Islands if she has satisfied herself there were no discussions with landowners prior to the announcement in the local media of selected areas of special conservation under EU Directive 43/92; and if she will make a statement on the matter. [2330/00]

This directive was transposed into Irish law by means of the European Communities (Natural Habitats) Regulations, 1997, in February 1997. The first part of Ireland's proposed SAC network was publicised in March 1997 by the then Minister, Deputy Higgins.

When I became Minister, I concluded that adequate consultation procedures had not been introduced. I immediately directed that no site be formally transmitted to the EU Commission until after adequate consultation occurred.

My Department has had numerous meetings with farming, conservation and other interests since the original sites were publicised and prior to the publicisation of additional sites in August-September 1999. In addition, I have established local liaison committees to discuss difficulties arising out of the proposals, where landowners are agreeable to their formation.

I have also established an independent advisory board to make appropriate recommendations to me in respect of objections submitted by landowners regarding the proposed sites. This board is chaired by the former Ombudsman, Mr. Michael Mills, and comprises representatives of landowners and conservation groups. I have indicated to the EU Commission that I will not formally transmit a site until all relevant objections have been fully examined and decided upon.

I am pleased that I have implemented a full consultative programme in respect of these proposals best suited to ensuring successful implementation of the directive in this country.
