89 Mr. Hayes asked the Tánaiste and Minister for Enterprise, Trade and Employment the number of local authorities which have implemented by-laws in connection with the Casual Trading Act, 1995; and her views on the necessity to amend this Act following representations to her office from the Irish Organisation of Market and Street Traders. 119 Mrs. Owen asked the Tánaiste and Minister for Enterprise, Trade and Employment if she has examined the case being made by the Irish Organisation of Market and Street Traders concerning the difficulties its members are encountering due to the need to amend the Casual Trading Act, 1995; if she will discuss this issue with the relevant Department; and if she will make a statement on the matter. I propose to take Questions Nos. 89 and 119 together.

There is no statutory requirement under the Casual Trading Act, 1995, for local authorities to inform me as to whether they have made by-laws under section 6 of the Act. The Act clearly places the responsibility for the making of by-laws on local authorities. While there is no statutory requirement in the Act requiring them to inform me as to their actions, I am aware that many local authorities have introduced by-laws but some remain to do so.

The Casual Trading Act, the principal purpose of which is the regulation of casual trading by local authorities, has been in effect for less than five years and as I have stated many local authorities outside the major urban areas are in the process of implementing it in their own areas. Accordingly I have no plans to change the Act.
