Question:

144 Mr. Neville asked the Minister for Agriculture, Food and Rural Development the position with regard to the appeal of the decision to refuse payment under the REP scheme to a person (details supplied) in County Roscommon. [4745/00]

Following an inspection of the farm of the above applicant, a penalty of 100% was imposed in respect of the removal of a hedgerow, contrary to the scheme regulations. The penalty applied to his first year payment under the rural environmental protection scheme. The applicant appealed the decision and the matter was examined by my Department's appeals committee. The appeals committee decided to uphold the penalty and the applicant was informed on 3 February 2000 that his appeal had been unsuccessful.
