Question:

226 Mr. O'Shea asked the Minister for the Environment and Local Government if he will respond to a letter from a person (details supplied) in County Waterford regarding proposed planning legislation; and if he will make a statement on the matter. [9662/00]

The Planning and Development Bill, 1999, proposes to restrict the right of appeal to An Bord Pleanála to persons who make submissions or observations to the planning authority on the initial planning application. In his letter, Mr. Spencer expressed concern about this limitation for persons who did not object to a planning application because they were satisfied with the original proposal, but who feel adversely affected by changes to the development required by conditions imposed by the planning authority in the final decision. It is my intention, in response to this concern which was also raised by Senators when debating the Bill, to introduce an amendment to the Bill on Dáil Committee Stage. The amendment will enable An Bord Pleanála to accept an appeal from a person holding an interest in adjoining land which would be adversely affected by changes to the development required by conditions imposed on the planning permission by the planning authority.

227 Mr. Ring asked the Minister for the Environment and Local Government when the new local government Bill will be published. [9663/00]

The text of the Local Government Bill, 2000, is due to be submitted to Government before Easter for authorisation to publish and will be published soon after.
