Question:

183 Mr. Aylward asked the Minister for Agriculture, Food and Rural Development the progress, if any, on the appeal by a person (details supplied) in County Kilkenny in relation to ten and 22 month special beef premia. [10786/00]

The person named applied for premium on 29 animals under the 1999 special beef/bull premium scheme on 30 December 1999.

Following an inspection carried out it was found that two animals applied on were absent at the date of application. Consequently the person in question was deemed to have made a false declaration through serious negligence resulting in him being excluded from the 1999 premium scheme. The person named appealed this decision and following a review it was found that he had two animals which could have been applied on instead of the two absent animals. Therefore, the two animals in question have now been regarded as rejected animals resulting in a 16% reduction penalty on the remaining eligible animals. The person named has been informed of this decision.
