Question:

53 Dr. Upton asked the Tánaiste and Minister for Enterprise, Trade and Employment if her attention has been drawn to reports of a company (details supplied) which it is alleged has not fulfilled contracts agreed with customers; the action consumers can take in this case; and if she will make a statement on the matter. [11988/00]

I have asked the Director of Consumer Affairs to investigate the complaint referred to by the Deputy. In that regard, I understand that, earlier this week, the director also received a complaint about the company concerned. While she has no direct function in the matter, it may be that the intervention of her office could prove beneficial.

The provision of the type of service outlined would be a matter of contract law between the parties. In the circumstances, the individual concerned may have grounds for an action for breach of contract. This would be a civil matter for resolution by the parties themselves, if necessary by recourse to the courts.

Given the circumstances of the case, the individual concerned might consider seeking legal advice. There is a small claims procedure within the District Court structure which deals with claims of up to £1,000. The individual concerned could also bring the matter to the attention of the Garda if she believed there was a possibility of fraud.
