Question:

109 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 sheep headage and premia. [12134/00]

The 1999 area aid application details for the person named have now been entered on the Department's electronic database. The person named claimed a total of 87.88 hectares on his 1999 area aid application. Following processing of his application an area of 84.40 hectares was determined. This represents a difference of 3.48 hectares or 4.12% between the area claimed and that determined.

Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%, the penalty is based on double the difference when it is between 3% and 20% and when the difference is over 20%, a 100% penalty must be applied. Therefore, in this case a penalty of 6.96 hectares has to apply, leaving the area for payment purposes at 77.44 hectares. Any payments due will issue as soon as possible.

Question:

110 Mr. G. Reynolds asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Leitrim will receive headage and suckler cow grants. [12135/00]

As stated in my reply to Parliamentary Question No. 150 of 14 December 1999, the applicant included commonage in his 1999 area aid application but did not provide proof of his entitlement to a share of the commonage. As the applicant is unable to provide such proof, my Department has requested a search of the records of the former Land Commission to try to resolve the matter.
