Question:

198 Mr. Deenihan asked the Minister for Agriculture, Food and Rural Development when suckler cow premium payment will be made to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [12402/00]

The area aid application for the person named has been processed. A query arose in relation to land being claimed by him as it was also being claimed by another person. The person named was informed of the position and has now submitted correspondence indicating that he should not be claiming the land in question.

Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference between the area claimed and the area found is less than 3%. Where the difference is between 3% and 20% the area found must be reduced by twice the difference found. When the difference is over 20% no payments related to the area can be made. In the case of the person named, the difference found was over 20% and therefore payment of 1999 cattle headage and suckler cow premium cannot be made.
