Question:

379 Mr. Spring asked the Minister for the Environment and Local Government if his attention has been drawn to the general dissatisfaction felt by landowners along the N21 between Castleisland and Tralee whose farm lands are being compulsorily purchased by Kerry County Council; and if he will appoint an inspector to liaise with the county council and a representative of the landowners. It is assumed that the Deputy is referring to the Kerry County Council Compulsory Purchase (N21 Single Carriageway Ballycarty to Killally) Order No. 11998. This order was confirmed without modification on 24 November 1998. The administration of the order is a matter for the local authority and I have no function in the matter. Compensation is payable by local authorities for land acquired by them on the authorisation of a duly confirmed compulsory purchase order. This is a matter for negotiation between the local authority and the property owners concerned. In the event of dispute either party has recourse to the land reference committee for the appointment of an official property arbitrator to determine the case.
