Vol. 519 No. 2

Written Answers. - Noise Pollution.

Seán Haughey

Question:

252 Mr. Haughey asked the Minister for the Environment and Local Government if he will introduce legislation to deal with the problem of noisy neighbours who play loud music late at night during parties on an ongoing basis; and if he will make a statement on the matter. [13512/00]

Sections 107 and 108 of the Environmental Protection Agency Act, 1992, No. 7 of 1992, and regulations made thereunder, the Environmental Protection Agency Act, 1992 (Noise) Regulations, 1994 (S.I. No. 179 of 1994), provide local authorities with adequate powers to address problems of noise pollution. In addition, any person may seek an order in the District Court under section 108 of the Act to have noise, giving reasonable cause for annoyance, abated. A public information guide outlining the legal avenues available to persons experiencing neighbourhood noise nuisance is available from my Department.

I have no proposals to introduce further legislation in this matter.
