Liam Aylward

Question:

125 Mr. Aylward asked the Minister for Agriculture, Food and Rural Development if, further to Parliamentary Question No. 138 of 7 March 2000, he will now release to Deputy Aylward a comprehensive report concerning this person (details supplied) in County Kilkenny; and if any progress has since been made. [13423/00]

As indicated in my reply to parliamentary Question No. 138 of 7 March 2000 the person named applied for 1998 suckler cow premium on 40 animals on 29 October 1998 and for 59 animals on 4 June 1999 under the 1999 suckler cow premium scheme.

Under the terms and conditions of the suckler cow premium scheme applicants must be registered herdowners in order to qualify for payments. The person named applied to have the above quoted herd number transferred from his uncle to himself on 30 October 1998. There is a court order against his uncle which has not yet been fully cleared and legal advice is that the herd number cannot be transferred from the uncle to the person named until this matter is resolved. Both the herdowner and the person named have been written to seeking clarification on whether or not the transfer of the herd was made with encumbrances. No reply has been received to date. Consequently, no payments can issue to the person named as he is not a registered herdowner.

The registered herdowner made a request under the Freedom of Information Act in October 1999 for all records on file in relation to transactions under both TB testing and premium/headage grants and payment thereof since August 1997. This request was granted and copies of all records were forwarded to the herdowner on 25 November 1999.
