Question:

73 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will have his 1999 area aid application reverted to its original status to reflect his request to withdraw the amendment resulting in a total forage area of 50.30 hectares. [15996/00]

The area aid unit did not receive an application from the person named requesting that his original amendment request be ignored. Therefore, the area for payment purposes determined in the case of this 1999 area aid application is 29.24 hectares.

Question:

74 Mr. McGinley asked the Minister for Agriculture, Food and Rural Development the current position regarding an application for 1998 and 1999 cattle and sheep headage for a person (details supplied) in County Donegal. [15997/00]

As stated in my reply to Parliamentary Question No. 155 of 19 April 2000, the person named submitted a 1998 area aid application that included a parcel of land in respect of which a dual claim was determined. My Department contacted the herdowner to clarify the matter some time ago, but no response has been received. Consequently the area aid application could not be fully processed and this in turn has held up processing of his 1998 applications under the 1998 cattle headage and suckler cow schemes.

The person named claimed a total of 19.54 hectares on his 1999 area aid application. Following processing of his application an area of 13.80 hectares was determined. This represents a difference of 5.74 hectares or 42% between the area claimed and that determined.

Under Article 9 of EU Regulation 3887/92, when the difference is over 20%, a 100% penalty must be applied. Therefore, in this case as the overclaim is greater than 20%, no payments can issue in respect of his applications under the 1999 cattle headage or suckler cow schemes.

There is no record of any applications being received under the 1998 or 1999 sheep headage schemes.
