Question:

112 Mr. Durkan asked the Tánaiste and Minister for Enterprise, Trade and Employment the current position in relation to below cost selling; the number of such instances that have been reported or brought to her attention in recent times; and if she will make a statement on the matter. [16739/00]

The ban on below cost selling is contained in the Restrictive Practices (Groceries) Order, 1987, which is enforced by the Director of Consumer Affairs. Since the order came into effect, I understand that the director has received over 60 complaints, including some recent complaints, about alleged breaches of the order. Over half of these complaints related to below cost selling.
