Question:

163 Mr. Connaughton asked the Minister for the Environment and Local Government if boundary fencing, in close proximity to the road either in national primary, national secondary or county roads, can contain barbed wire or electric fencing; and if he will make a statement on the matter. [18891/00]

There are legal powers available to local authorities, involving application to the District Court, to require a landowner to abate any nuisance to a public road caused by a barbed wire fence on land adjoining the road.

Roads legislation does not appear otherwise to provide for direct restrictions in relation to type of fencing.
