269 Mr. U. Burke asked the Minister for Arts, Heritage Gaeltacht and the Islands the reason she will not make information requested under the Freedom of Information Act, 1997 available to a person (details supplied) in County Mayo who has appealed designation of part of her lands; if she will give the date of this appeal; its present status; the persons involved in this appeal; and if she will make a statement on the matter. To date, a representative of the named landowner has made in excess of 20 requests under the Freedom of Information Act. Most have been answered but three are currently being proposed, following clarification of certain requests with the requester. If the landowner is unhappy with any of the replies received she has the option of having her requests examined at a higher level within the Department or she may refer them to the Information Commissioner.
The person named informally appealed against the designation of her lands. The appeal was not granted on internal review by Dúchas. She was afforded and accepted the opportunity to have her case referred to the SAC appeals advisory board. The appeal is currently with the board. As the board considers appeals independently and then advises me, I am unable to comment on any deliberations which may be taking place at the board concerning this appeal in advance of receiving their advice.
