Question:

228 Mr. M. Higgins asked the Tánaiste and Minister for Enterprise, Trade and Employment if she has satisfied herself with the distribution arrangements for Irish films through video stores, that they are not in breach of the norms of fair competition; and if she will make a statement on the matter. From a competition perspective, the distribution arrangement for Irish films through video stores and all other business arrangements in this or other industries is subject to the Competition Acts, 1991 to 1996, which apply to all areas of the economy. The Competition Authority, which operates independently of me, is responsible for the enforcement of the Acts.

Accordingly, allegations of any practices pertaining to any sector, product or service, including films which are contrary to competition law, may be pursued in one of two alternative ways; a person alleging anti-competitive activity within the terms of the Competition Acts may take civil action under section 6 of the Competition Act, 1991, or, make a complaint to the Director of Competition Enforcement at the Competition Authority requesting him to investigate the alleged breaches.
