John V. Farrelly

Question:

204 Mr. Farrelly asked the Minister for Agriculture, Food and Rural Development the reason for the delay in the payment of area aid to a person (details supplied) in County Meath. [27447/00]

The 2000 area aid application for the person named was randomly selected for inspection in accordance with EU regulations. As a result of the inspection the land parcel details on the application had to be re-digitised on the Department's electronic database. This procedure will be completed shortly.

The person named applied for special beef premium on 29 animals during 2000. Payment will issue following the resolution of the area aid situation.

205 Mr. Finucane asked the Minister for Agriculture, Food and Rural Development when a REP scheme payment will be made to a person (details supplied) in County Limerick. [27540/00]

Question:

206 Mr. G. Reynolds asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Leitrim will receive their 1999 and 2000 cattle headage and area aid. [27549/00]

An over-claim has been identified on one of the land parcels claimed by the person named in 2000. Maps were issued to the person named and she was informed of the extent of this overclaim. The applicant agreed that the boundary of the land parcel, as digitised and validated by my Department, was correct and the difference between the amount claimed and the gross area of the land parcel was 2.07 hectares. Under Article 9 of EU Regulation 3887/92, as the difference was between 3% and 20% of the correct area, a penalty of twice the difference was applied. The total forage area has, therefore, been reduced from 31.23 hectares to 25.02 hectares and the 2000 area aid application has been processed on this basis. Payment of her entitlements under the 2000 cattle headage scheme and the 2000 suckler cow premium scheme will issue within the next seven days. Payments will be calculated on the basis of 25.02 hectares.

The person named was paid her full entitlement under the 1999 suckler cow premium scheme. The 60% advance of £798.84 issued on 20 December 1999 and the balance of £532.56 issued to her on 7 February 2000. The amount of £70.90 under the 1999 euro-compensation on suckler cows issued to her on 20 December 1999.

Submission of an area aid application is a condition of eligibility under the headage schemes. While the person named applied on 18 animals under the 1999 cattle headage scheme she did not submit a 1999 area aid application. Consequently, in accordance with clause 22 of the terms and conditions of the 1999 cattle headage scheme, no payment can issue to her under this scheme.

Question:

207 Mr. G. Reynolds asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Leitrim will receive payment under the REP scheme. [27582/00]

The fifth year payment under the REP scheme issued to the person named on 24 May 2000. A 10% penalty was deducted from this payment. The person named appealed the penalty and the REPS appeals committee recently reviewed the matter. The applicant was informed by letter dated 15 November 2000 that the appeal was not successful.
