87 Mr. R. Bruton asked the Minister for the Environment and Local Government if he has considered introducing legislation which would restrict the selection of species of trees and plants which could be planted in residential areas in order to overcome problems such as those caused by the planting of species that grow to an excessive height. 88 Mr. R. Bruton asked the Minister for the Environment and Local Government if his atten tion has been drawn to legislative provisions in other countries that limit the height of trees in residential areas; and if he has considered the introduction of any such legislation here. [6265/01]

I propose to take Questions Nos. 87 and 88 together.

I am aware that there are proposals for legislation in relation to the height of trees and plants in other jurisdictions. However, I have no plans to introduce legislation restricting the height of trees or plants in residential gardens. Where a dispute arises as to the height of a particular tree on a person's private property, this is a matter to be resolved between the parties concerned.
