Question:

165 Mr. Naughten asked the Minister for Public Enterprise if the Director of Telecommunications Regulation has powers to implement in full the ODTR regulatory framework for access in the mobile market; if so, the reason the Office of the Director of Telecommunications Regulation has not used these powers in relation to a dispute (details supplied); and if she will make a statement on the matter. I understand that the Director of Telecommunications Regulation is currently engaged in a dispute resolution process between the parties on this matter. In the circumstances, it would not be appropriate for me to comment on the question of the director's powers in relation to the matter. In relation to the dispute referred to by the Deputy, as the director is statutorily independent in the performance of her functions, I cannot comment on the exercise by the director of her functions in specific cases.
