Written Answers - Employee Rights.

Question:

135 Mr. R. Bruton asked the Minister for Public Enterprise whether employees of a company (details supplied), who were formerly in State employment, still have certain rights by virtue of their previous status or if restrictions are imposed on management in terms of the payment or conditions of the workers of the now privatised company; and if she will make a statement on the matter. [12731/01]

The following provisions of the Postal and Telecommunications Services Acts, 1983 to 1999, which may be relevant to the matters raised by the Deputy, are still in force: section 16(2)(e) of the 1983 Act, relating to provisions to be included in the company's articles of association; section 45 of the 1983 Act, as amended by the 1984 Act, relating to the terms and conditions of employment of staff who transferred to the company from the Department of Posts and Telegraphs; section 46(4), (4)(a), (5), (8), (9) and (11) of the 1983 Act, as amended by the 1999 Act, relating to pension provisions of those staff; section 47 of the 1983 Act, relating to funds or trusts for the benefit of staff and their dependents; and section 4(1) of the 1999 Act relating to pension schemes.

The application of these provisions is a matter between the company and the employees concerned and I have no function in relation to the matter.
