Question:

359 Mr. Spring asked the Minister for Social, Community and Family Affairs the reason the pension of a person (details supplied) in County Kerry was reduced when the pensioner's wife received disability benefit. [13710/01]

Social Welfare Regulations provide that entitlement to qualified adult allowance ceases when the spouse-partner of a claimant is entitled to or is in receipt of a Social Welfare payment in his or her own right. In this case the person concerned was in receipt of a invalidity pension, including a qualified adult allowance in respect of his spouse. The allowance ceased however, with effect from 26 January 2000 when the spouse was awarded disability allowance in her own right.
