Question:

396 Dr. Upton asked the Minister for Justice, Equality and Law Reform his views on the application of the terms of the Criminal Justice Act, 1999, in view of a case (details supplied). [13853/01]

As I am sure the Deputy is aware, the courts are independent in the exercise of their judicial functions. Accordingly, the application of the provisions of the Criminal Justice Act, 1999, in all cases is a matter for the trial judge and, consequently, it would not be appropriate for me to comment on the decision reached in any particular case.
