325 Mr. Higgins (Dublin West) asked the Minister for Justice, Equality and Law Reform if, further to Parliamentary Question No. 220 of 6 February 2001, a member of the Garda Síochána in County Galway carried out an investigation following a complaint by a person in County Galway concerning an assault on him at a night club in Galway on 30 May 1997; and, if so, the findings of the Garda investigation. I am informed by the Garda authorities that the person referred to by the Deputy alleged to the Garda that he was the victim of an assault at a night club on 30 May 1997. The allegation was subsequently investigated and the directions of the DPP were sought. I understand that proceedings were commenced by way of summons and the case first came before the District Court on 13 May 1998. The case was adjourned on several occasions and finally on 2 December 1998 the District Court judge dismissed all the charges against the person referred to and the other parties in the case. As the Deputy will be aware, the Judiciary is independent in the exercise of its functions and it would not be appropriate for me to comment on the matter.
